IL LEBBIO does not sell wine or other alcoholic products to persons above indicated, so the courier will not deliver the wine or other alcoholic products to that people and will require a photo ID to verify the age. TERMS AND CONDITION OF SALE
all retail prices are VAT included;
all the products displayed in our online shop are actually available in the company;
the shipping invoice, if requested, with the list of all the Products and all legal specifications will be sent together with the goods (necessary VAT number and / or Tax Code);
the prices of the Products and of the special offers, may be changed by the company periodically also according to the items of products. The Company reserves the right to make and publish these changes, without any prior notice;
in the event that a price has been incorrectly published for any reason, IL LEBBIO reserves the right do not confirm the order and reserves the right to waive the sale, giving prompt notice to the customer.
IL LEBBIO is not responsible in any reason, including for example: data loss or lost earnings or incomes or profit, by the use of www.illebbio.it website and its contents.

The agreement between the Customer and IL LEBBIO shall be deemed to have been concluded only after the order acceptance by IL LEBBIO, via confirmation email.
On completing the purchase order procedure, the Customer declares to have read and understood all the information here included regarding i.e.: the purchase, withdrawal, complaint, privacy protection procedure and to accept all the general and payment conditions as expressed in the general conditions of sale.
SHIPPING COSTS, DELIVERY TIMES AND PACKAGING
To guarantee an excellent service, all the shipments are entrusted to the best couriers on the market. The cost of shipments depend by the order done, according to the SHIPPING REFERENCE TABLES.
All the products will be transported with suitable packaging according to the best standards for the type of products sent.
Deliveries will be made within the time table indicated in the SHIPPING REFERENCE TABLES, starting from the date of notification of payment after the acceptance of the order.
The Company will send an email confirmation to the customer as soon as the shipment starts, with the tracking code to check the progress of the delivery .
SHIPPING
The delivery will be done at the destination address indicated in the order form.
The carrier will make two attempts to deliver the products to the address indicated by the customer.
In the event that these attempts are unsuccessful, the products will remain in stock at the carrier’s warehouse for 5 (five) working days available to the Customer.
In case of non-collection of the products by the Customer within the time specified above, the order will be automatically cancelled and the products returned to IL LEBBIO.
IL LEBBIO will return the amount paid by the client reduced by all the costs to managing the order, the outward shipment, the stock and the return shipment and any other expenses sustained .
DEFECTIVE GOODS
In the case of defective goods, the products can be returned to IL LEBBIO within 10 days of delivery.
The shipping and packaging costs for the return will be charged to the customer.
The defective goods will be replaced or refunded (if sold out) by IL LEBBIO.
DAMAGED SHIPPING
If the packaging shows evident signs of tampering or deformations, the customer can refuse the package or can accept it signing the delivery note writing «ACCEPT WITH RESERVE», and specifying the anomaly found (e.g. wet packaging, hole in the cardboard, dent on the cardboard, etc.).
Otherwise, no complaints or replacement will be accepted. Any problems found must be reported within 5 working days from the delivery, the date of the delivery note will attest it.
In the event of one or more products were not in perfect condition, because they were damaged during transport, the customer can contact the company at the indicate addresses, documenting the damage as much as possible with a photo, sending the delivery notes, a declaration of damage and whatever else could be useful for this purpose.
The Company will take care of replacing the damaged products in the shortest time or, if this is not possible, to refund their amount.
NON-COMPLIANT WINE/PRODUCTS
Non-compliant Wine/Products means that the goods delivered has different characteristics compared to the manufacturer’s quality standard I.e.: the typical “corky smell” for the wine, rather than loss of liquid/material or label completely damaged during the transport.
Non-compliant Wine/Products will be replaced, as long as it is still available, without any cost by the customer.
If the wines/products are no longer available, the amount spent will be refunded.
The customer must promptly report the alleged non-compliance via email to info@illebbio.it.
Within 2/3 working days the Company will contact the customer to share with him the procedures for the possible collection or replacement of the products.
The products must be returned with at least two-thirds of the original content and corked with the original cap suitably trimmed (for the wine) or in the original packaging (for other products).
The return must be entrusted to the courier in the original packaging (the same quality standard) to well protect the goods during the transport.
Once the products has returned and the non-conformity has been confirmed, the company will provide a new shipment of wine bottles of the same vintage or products of the same type, if still available, or alternatively, will be the refunded of the amount spent.
In the event of a dispute, the wine/products will remain available at IL LEBBIO for subsequent grades of judgment by the competent authorities on the matter, and the courier withdrawal costs has charged on the costumer.
RIGHT OF WITHDRAWAL
Purchases on the www.illebbio.it website are subject to Legislative Decree 206/2005 and Legislative Decree 21/2014, which guarantees to the customers the right to withdraw, for any reason, from the purchase contract.
The customer has the right to withdraw from the purchase contract without any penalty and without specifying any reason, giving notice within 14 working days from the date of receipt of the goods, by registered mail with return receipt addressed to: IL LEBBIO – Loc. San Benedetto 11/c – 53037 San Gimignano – SIENA ovvero con PEC: illebbio@pec.it.
The above communication may be sent, within the same term, also by telegram, fax or e-mail, but necessary confirmed soon by registered mail with return receipt or a EMAILPEC within the following 48 hours. For traceability, the customer must indicate:
Document number of the purchase.
Bank details for any refund by bank transfer.
The customer have to return the goods at his own expense and under his own responsibility, within 14 days from the date of the withdrawal, to the Seller’s address.
Essential condition for exercising the right of withdrawal is the substantial and total integrity of the goods.
The goods must be returned perfectly intact, in its original packaging complete in all its parts (documentation, accessory equipment, etc.) and without affixing labels or adhesive tapes or anything else.
Perishable goods originally shipped by IL LEBBIO by refrigerated vehicles or temperature-controlled isothermal containers, must be returned in the same way in order not to deteriorate the product, under penalty of cancellation of withdrawal right.
IL LEBBIO will refund the sums paid, by bank transfer or by reimbursement on the credit card used for the purchase, within 10 working days from the receiving of the goods by the customer, once all the necessary conditions have been verified.
If the returned goods will be damaged during the transport organized by the customer, IL LEBBIO will notify the customer via e-mail within 5 working days from receiving the goods, to allow the customer to carry out the complaint procedures against the courier used.
If the returned items are not sent in accordance with the storage instructions (above described), the right of withdrawal is cancelled.
The right of withdrawal does not apply on made to measure goods or perishable rapidly.
The right of withdrawal does not apply to purchases made by companies or professionals with VAT number .

APPLICABLE JURISDICTION
The sales agreement between the Customer and IL LEBBIO has concluded in Italy and governed by Italian law.
In case of Italian Customer the solution of civil and criminal litigation arising from the conclusion of this distance selling contract, has jurisdiction the court of his residence; in all other cases, the court of SIENA (Italy) has jurisdiction.
ONLINE DISPUTE RESOLUTION FOR CONSUMERS
IL LEBBIO inform the Consumer residing in Europe that the European Commission has set up an online platform who provides an alternative dispute resolution tool.
This tool can be used by the European Consumer to resolve any dispute relating to and/or deriving from contracts for the sale of goods and services stipulated on the web, in a non-judicial way.
